Illegal encroachment of bbmp property

Respected Sir / Madam,

I had given a complaint with the BBMP regarding a BBMP vacant land and public road encroachment by contructing a house which is below the high tention electric wires near my house,. In 2021 a 8 year old boy died and proior to that another 17 yr old boy. When the BBMP failed to act, I filed a case with Lokayukta and the case is going on from the past 6 months, insetad of acting on our complaint the BBMP is helping the encroachers. Not only encroachment, they are stealing electricity from many years, they are involved in various illegal activities too i.e. smoking & selling ganja in public, honey trapping, prostitution, consuming alcohol and screaming and shouting in the middle of night gathering local goons and other attocities. The police is also not acting as they have political influence and they local political workers too.

In Dec 2024, the encroachers have approached court for injuction and a case has been filed against the BBMP commissioner with evidence such as voter id, aadar card, ration card etc. They do not possess any legal documents for the property.

Kindly suggest what is the procedure and how to proceed with this issue. My family is residing  here since 1947.

You may file a petition under order 1 rule 10 CPC to implead yourself as necessary party  and a defendant, being the neighbor, and are facing disturbance and nuisance due to their illegal and arrogant acts and strongly object to their relief.

You can also file a counter claim in the same suit  to evict them from the encroached property and to restore peace to all the residents residing in the neighbourhood. 

You can also file a PIL before high court seeking relief of ejecting the from the encroached property.

Since your case before lok ayuktha is pending you may follow it up properly
