Illegal occupancy of colony pond

This query is regarding a colony pond, since long time we heared that this pond  is vested with RR department of Govt Of West Bengal,and local ward commottee give lease of the said pond by passing a resolution in general meeting against moneytory consideration. Maintenance liability of the pond belong to the lessee.

Now a person demanding that he is the owner of the pond and trying to filling it with rubbish and garbages.The area of the pond is more than  5 cottach and situated within urban area of Kolkata.

Now My query is 

(1) How could we back check the ownership position of the pond from government department.

(2) What legal steps available before colony people to stop this illegal encrouchment

you can get the details of the ownership of the pond by filing application under RTIAct to the concerned dept.

You may have to approach the competent authority for relief and remedy because you have taken the pond on lease, the lessor being the ward committee shall answer to the plights you suffer.
