Illegal occupier

The flow of facts is as follows:

  1. My father initiated a suit in High Court  against Sri Subal Ch Ghosh who illegally occupied a piece of land when my father was posted outside the State .
  2. Sri Subal Ch Ghosh initiated another suit in the Lower Court and the Lower court ordered statusquo over the said piece of land in 1997.
  3. My father died last year
  4. Sri Subal Ch Ghosh did not serve any notice to any of the legal heirs of my father

I want to know whether the statusquo is still continuing ?

I shall be greatly obliged if the answer is given quoting relevant acts, rules and regulations or judgements or orders of any case

there is a time limit within which as a legal heir of plaintiff you must inform the court that you are taking up the case against the respondent failing which the case would be dismissed.i think the time limit is a year
