Respected lawyers,
Can an Indian citizen file a civil suit for recovery of money in a case of breach of sale agreement against a foreign national?
The money involved is Rs1 lakh paid to the foreign national who is not returning money though has not honoured the agreement of sale.

If the offence is committed in India and the foreigner is available in India for inquiry and other related legal actions, a complaint can be lodged with the police, let the police decide about the jurisdiction aspect.

Thanks for your reply.
It was actually the police who suggested to file a civil suit as the foreigner resides outside the country and come to India every 4/5 years.
Can the civil court send him summons? Thanks in advance.
