Spartan,
Impotency is ordinarily said to mean an incapacity physically and mentally to have normal s*xual intercourse. The courts are of the view that partial intercourse would not amount to consummation of marriage and if the wife is incapable to participate in the performance of the s*xual intercourse to the fullest extent, it will be established in law that she will be deemed to be impotent. It means inability to have normal s*xual intercourse, it may be due to malformation of the genital organ. A defect in the female organ which makes normal s*xual intercourse not possible shall come within the definition of impotency. The essential ingredient of impotency is the incapacity for accomplishing the act of s*xual intercourse and in the context it means not partial or imperfect, but a normal and complete coitus. This incapacity may arise either from a structural defect in organs of generation which is incurable and renders complete s*xual intercourse impracticable or from some incurable mental or moral disability vis-a-vis the other spouse resulting in inability to consummate marriage. To get a decree of nullity two conditions are to be satisfied; 1) marriage has not been consummated, 2) Non-consummation is due to the impotence of the respondent. Hello, The female impotency is a different case and need few details before to answer this. 1.How u decided the female impotency?when u got married? 2.Did u tried to consumate? The female impotency is girl is not matured and she will not have periods at all. She will not get pregnant sudden increase or decrease of weight abnormal symptoms like behaving a like a male and always try to fight for small things try to avoid s*x saying so and so reason hair loss and no free motion thyroid unwanted hair on face and all over the body..i.e excessive hairs is there any 498A case running against you? if your marriage is below 1 year file a divorce petition under section 12A HMA(female impotency) and the medical test are. 1.TSH 2.LH 3.FSH 4.ULTRA SOUND SCANNING 5.ANDROGENS TEST 6.CHROMOSOMAL ANALYSIS Do all these tests in Govt hospital and get a hospital seal and doctor signature. court will accept only this. Remember private doctors will not help you and will not reveal girl's impotency..always they will try to cheat you. |
Most of these conditions are MEDICALLY TREATABLE. A cotested divorce on grounds of these medical conditions & wife's impotency is almost impossible!
