Inconsistent positions in pleadings

A person flles a rejoinder in a case at the State Rent Controller stating that he is a caretaker of the property, and then after few months in defending a writ petition in Hon'ble High Court states that he is not a caretaker but a purchaser of the property.

How these inconsistent positions could be tackled, would judicial estopple apply to this case in holding him to be a caretaker. Any rulings regarding this would be greatly appreciated.
