Information under rti act, 2005

Sir/Madam,

"I am writing to request clarification regarding the Right to Information Act, 2005. I filed a complaint and subsequently submitted an RTI application to your Head Office seeking information related to that complaint.

The Head Office sent the requested information via Indian Post. However, delivery was unsuccessful as neither I nor any family members were present at my residence at the time. The postal service returned the letter to your office.

Upon learning of this, I promptly requested the concerned section of your office to resend the information. Unfortunately, my request has been ignored.

I would appreciate guidance on how to proceed in this matter. Specifically, I would like to know:

  1. What are my rights under the RTI Act, 2005, in this situation, where the information was initially sent but not received due to postal delivery issues?
  2. What steps can I take to compel the concerned section to resend the information I requested?
  3. Is there a specific provision within the RTI Act that addresses this scenario?
  4. What is the correct procedure to file a first appeal in this scenario?

If your RTI information is returned undelivered because your house was locked, you should contact the Public Information Officer (PIO) who sent the information and inform them about the delivery issue, requesting them to resend the information using an alternative method, such as registered post or by providing a new delivery address where someone can receive it; you may also need to follow up with the postal service to confirm the reason for non-delivery. 

Reach out to the PIO immediately and explain the situation, providing details about why the delivery failed. 

Maintain a record of your communication with the PIO, including the date and time of contact, and any details discussed. 

Under the RTI Act, you can file an appeal with the designated First Appellate Authority within the prescribed time limit, explaining the delivery issue and requesting the information again. 

If the first appeal is not satisfactory, you can approach the Central Information Commission (CIC) or the State Information Commission (SIC) to further pursue the matter.

"The Head Office sent the requested information via Indian Post. ..........." it is not the Head Office, but the Public Information Officer (PIO) who provides the information.
