what is the procedure to restrain a person from encroachment to our own plot where he is constructing house. how many days it will take to get the order from court.

You can file a petition for grant for injunction to you in civil court having jurisdiction to entertain such a case and also pray for a temporary injunction.
The purpose of a temporary injunction is to maintain the status quo and prevent irreparable damage or change before the legal questions are determined. After the trial the court may issue a permanent injunction to you.
