Insurance case

My friend was driving a bike on a bogus license (later discovered) with his friend on back. He met an accident and she suffered severe injuries, later they filled a claim making him accused number 1, whereas he is not responsible in any way he wasn't aware that he is holding a bogus license. And the owner of the vehicle is accused no. 2 and insurance company is number 3. Could you please guide, in this case who would be liable to pay the amount of claim?
