Q1. Can the ICC give it's decision against the complainant if she doesn't appear or doesn't participate in the inquiry.
Ans: Of course the ICC shall have to give its report on the basis of statement of deliquent official / witnesses and records provided during the course of fact finding investigation
Q 2. Is it mandatory for the ICC to be unbiased, fair and transparent even if the complainant refuses to participate in the inquiry
Ans: Generally ICC shall have to submit its report on the facts submitted by both sides.Your question is itself baised and unfair.
.Q 3. Is it mandatory for the ICC to inform the complainant about the constitute of ICC and disclose the name, designation of members and disclose the name of ngo as well
Ans: Yes
Q 4. What is the remedy left for absentee complainant if after the inquiry she finds out that the inquiry was not done in fair and transparent manner and on the facts given in the complaint.
Ans: Proceed as per rules / law applicable.
