Is attending lokayukata for settlement a compulsory

dear sir

mr x is called for attending a pre littigation matter before submitting to lokayukta (lok adalat) by his rival. As the applicant submitted a letter saying some alligations aginst him. is it is compulsory that mr x had to attend lokadalat for settling his issue. there is no other communication or exchange of diaglogues or statements before hand.

No. Not at all. No need to attend lokayukta or lokaadalat. Unlesss u get a notice from the honourable courts.

First of all, it is not set to lok adalat hearing vide request from only one side. Ofcourt the trial court may recoomend it.

 

 

Lok adalat does not necessarily go as per merits of case and also it is NOT APPEALABLE.

 

 

Also Other party (Mr X) should get the notice of the same if case is set for lok adalat.

There is no compulsion to attend, but better to go there mention that Mr X disagreeing entirely to any terms of Applicant for settlement. Just state that X prefers to defend on merits.

 

But lok Adalat is a quick remedy if both parties are sensible. Mr X should tell other party by other means that if they want Mr X to appeat then if can't be one-way traffick to concede to all demands.

 

Mr. X has opportunity to negotiate!!! But tread with care!!
