Yes Right of Privacy is Fundamental Right under Article 21 of the Constitution. There are many judgments, please search for "privacy" in any legal search website.

right to privacy is a fundamental and legal rights. File Civil Suit, Private Criminal Complaint or Writ petition, more than one also, for your relief.
At first commence from Police Station, but do not hope that they will file FIR. They will issue only a warning, thats all. However without said procedure, you cannot prove infringement of privacy.

Policemen have no power to punish the wrongdoer, but normally the witnesses are won over prior to trial, thus the Policemen tell by his behaviour that, when the cases are relying upon oral evidence, file the Criminal complaint at Magistrate court, so that we will have nothing to worry will you change your statemnt in court.
However filing other complaints without Police complaint may not be believed to be true, thus first step is Police Station Complaint.
