My sister is working as Sikshan Sewak since more than 2 years on state grantable high school which is run by educational NGO
Her proposal was rejected by Education officer stating that ST candidate to be deputed on same vacancy. As per roster copy any 1 of OBC / SBC / ST can be fitted on same post but priority to be given to ST candidate. Kindly note vacancy was 1 & as per % of categories any one of OBC / SBC / ST category can be fitted.
Educational NGO was given advertisement for ST candidate & written note that if suitable candidate won't be available others will be recruited. My sister selected as OBC candidate because not single ST candidate was available for interview.
My sister written petition in Bombay high court against education officer & NGO, which is in progress.
Can any one please give me reference judgments of high / supreme courts in connection with such matter of rotation of category based on non availability of candidate ?
