Sir,
For Sec 409 IPC. Punishment up to 10 years or imprisonment for life is provided. Sir if magistrate thinks that accused should be punished for more than 5 years he can refer the case to CJM under Sec 225.
But if CJM thinks that acuused deserve to be punished with life imprisonment. What can he do ? as he can not pronounce sentence for life imprisionment.
Whether he can refer the case to Session judge? If yes under which provision ?
