Land acquisation

Hi,

We have land in our home town and my father agreed to sale it to govt, but we filed as case against them for returning land back to us as they we were paying very less.

The case has been close and its on the govt favor, only 25% of land has been uitilised and rest has been rasied compunds.
 

Need help on this were can we apply for getting back the un utilised land as we are depended on this land.

Please share your views it would be great.

Have they paid full compensation to you for entire land or only 25% of land... If they have not paid compensation for the 75% of the land you can apply for getting back the said portion. If they have paid you compensation for 100% land  and the Govt wants they can retain the land acquired.

They have paid 100% for the land but it is very less and 75% of land is not used. So can we get back the un used land

If they have paid you compensation for 100% land and the Govt wants they will retain the land acquired. In such case they will not return. I do agree that  the amount of compensations is always less.

Can we talk to them and if they are not using the balance portion then can we get it back.

You can speak to them and request... I have my own doubts... Normally they dont return

Have heard that some one has got back speaking to them or can we put a fresh petition in court asking for higher compestion.

If you are sure that someone has got back by speaking to them you can also make an attempt... I dont think that you will get positive result by going to court

So means to say not go to the court, should i talk what level collector/minister or directly to the concern dept head who has acquired the land.

Contact the concern dept head who has acquired the land and thereafter decide future course of action..The dept head can guide you properly.

Need another help.

We have an ancestor property which has been encroached by people for past 25 years and few have built houses illegally, so need help to vacate them and we can sale it.

First let me know you are from which place?

What are you doing when they encroahed 25 years back..

If the title deeds are in your favour contact local Advocate for filing eviction case.. Such cases will take many years for getting favourable judgement.

Chennai and the land is in Vellor Dist. We took the EC (Encumbrance Certificate) is still there in our name.

So what shall we do now.
