Iam thankful for this service as Iam wondering how to enquire.my father
gave me 1.5 hec and he hold 2 hec ,out of 1 he sold.he abandoned us since childhood.mother she gave 1.5 out of 2 hec.father ,he is staying away us and now he is not giving right to me even I crossed 25 age.if we asked then he is demanding divorce.this is the problem what should I do .I can't be to wonder with courts as Iam job holder.1 what should I do
2.is he have the right to sell the land with out us

You are not able to state your problem clearly.

Why dont you meet with some lawyers in your locality and discuss the matter?

Which personal law applies in your case?

 

Or are all involved; Hindu?

Who was 1st title holder/owner of said property(ies) amongst the forefathers on property in question ;Paternal, Maternal side?

Was IT self acquired/earned in the hands of 1st title holder/owner?

How did IT devolve to last title holder/owner say your father?

Is it self earned/acquired or ancestral in the hands of your father?

What is said property; agricultural land, building, rural, urban?

The said property is in which state?

Or Are you sure the property is ancestral?

What is the opinion of a your own very able senior LOCAL counsel of unshakable repute and integrity specializing in such/revenue/civil matters and well versed with latest citations, LOCAL applicable rules/laws and having successful track record…. and worth his/her salt… with whom you have discussed  in person and have shown all property related docs.

Ancestral Property; the property that is  four generation old…. ….acquired by the Hindu great grand father, which then passes undivided down the next three generations up to the present generation of great grand son/daughter.

In case of property being ancestral you may succeed to have share..

In case of property being self earned/acquired you may not succeed to have any forced share..having attained majority and being employed.

Your mother may succeed to claim right to residence, maintenance…and may approach her own very able senior LOCAL counsel of unshakable repute and integrity specializing in Family matters and well versed with latest citations, LOCAL applicable rules/laws and having successful track record…. and worth his/her salt…
