Law on planting trees near the house

Dear Members,

I have a unique situation here. Recently we had constructed a house in our ancestral property which is also shared by my uncle. There total cost of the construction came up-to almost 15 lakhs.

Now the issue - My uncle who had built a house in the same property few years back was assuming that we would never construct the house. His house his behind our house with limited visibility to people. Out of jealously or spite he has planted coconut saplings around my house (in his part of the property). The damage from the tree can be substantial as the roots can permanently damage my house.

Is there any legal recourse for this situation? Can we give a notice to the tree owner (uncle) about the impending damage and would be required to remove the offending tree.

You can file complaint at municipal authorities. If they do not take action, move to file for compensation for damages at local civil courts.
