Dear friends ! very good thread has been started by shri y prakash. to continue this hereinafter i propose to put the questions with indication of name code and serial nos. for example my questions will bear sl no as vnt 1.,vnt2, vnt3....and so on .
Q. vnt 1. there is a decision pronounce by a single judge of high court against which SLP was dismissed in limine by the supreme court and there is a contradictory decision of same high court pronounced by two judges. petitioner's counsel is relying on first decision saying that it is a decision of supreme court. respondent's counsel is relying on second (two jj) decision saying that it overrides the judgment of single judge and first judgment can not be called a judgment of supreme court. Now what is proper to rely :
A. first judgment as it should be treated as decision of supreme court
B. judgment of two judges
C. two judge decision was perincurium
D. the court is not bound by any of two precedents
E. if you have any other opinion plz suggest .....................
