Leave and license

There are many views for registration of 11moths agrrement. Please let us know the right answer by giving a document or a link from whether everyone can get the required information.

And also let us know if registration is not needed then one should pay the stamp duty.

If yes, then how?

It is compulsory to register all leave and license agreement.

"UNDER Section 55 (1) of the Maharashtra Rent Control Act, 1999, any agreement for Leave and License or letting of any premises entered into between the landlord and the tenant or the licensee as the case may be should be in writing and should be registered under the Registration Act, 1908. Section 55 (2) imposes the responsibility of getting such agreement registered on the landlord."

Dear Sir

I agree to your feedback, but again it is mentioned that it should be registered under the registration act 1908, but this registration act it self says that registration is mandatory for agreements above 11 months.

And the term notwithstanding is used as a preposition to indicate that the provision that follows is limited by another provision.
