Leave and license agreement

Can I give my 4 room guest house to anyone with leave and license agreement but there's a condition by the tenant that there's no time limit of agreement is there any thing happen to my property that tenant have full possession and he sale my property to another person or take my property and also can I cancel that agreement anytime without any problem and take back our property can someone help me about this with full process and no one take my property and sale it to other.

Please help me 🙏🏻

Different Indian States have their own Leave & License/Rent agreement laws. However as a usual practice the term of Leave & License agreement should be for eleven months and should not exceed five years. In your interest you should not agree to a Leave & License agreement without a time period.

You should never agree to a leave and license agreement without a time limit. Without a fixed term, the tenant may claim long-term possession rights, making eviction difficult. Also, clearly state in the agreement that the tenant cannot sell, transfer, or sublet the property. To protect yourself, consult a lawyer to draft a legally sound agreement and include a termination clause that allows you to cancel it when needed.

If you give a house on leave and licence agreement to another person, you are landlord and he is tenant. If you die your legal heir will become the landlord and the tenant will continue as a tenant.
