Legal advise required to prove a marriage legal without the

Hello Sir I had done a court marriage on 27th July 2011 at bandra and according to the rituals at ram mandir. After that the girl was staying at her place and I was staying at my place until we decide to inform the families.

 

All of sudden I saw her in September with another guy and came to know that he was her fiance. Her family came to know about our relation and she refused to stand by my side. Now they have filled a case against me saying fraudularly I got married to her and my marriage is not legal because it was not registered. Help me.

dear querist,

she can not do another marriage as per the hindu marriage act the registartion og marriage is not necessary and religious ceremony done is enough to be legally wedded husband and wife as the hindu marriage is not a contractual in nature like muslim marraiges its religious ceremonial.there are many supreme courts judgements are also on this point,feel free to call for more details and legal help.

Hello Sir,

 

Thank you for your respond. She has filled it under 12 (1)(c) stating that I had forced her to get married to me. She says I was holding a poison bottle in my hand, I told her that I will throw acid on her, I will kill her and her family members and all those sh*t.

 

How do I prove my self. Whatever she has return is all fake. Also she flicked my memory card from my cell and destroyed all the pics and videos of the ceremony. Somehow I have been managed to get a video from a friend who was also present there but its not that clear because it was taken from an ordinary phone which had a normal camera.

 

How can I prove it to be legal. I’ve memorandum and declaration /notarized documents with me. Is that enough in the family court bandra?
