Legal dispute between builder landowner jv project

Has the necessary agreement for booking of flat was carried by the builder? Is there power of attorney was executed by owner and if the builder has acted under power conferred under POA ? If answer is yes, then owner is bound by the act of builders and as such agreements are valid so file suit for specific performance against builder and the owner and also for damages against them for each day delay.
