legal fee paid to advocate for s.138 cases

sir,

I am for a cooperative society., we file cases of cheque bounce and pay legal fee to lawyers.

is accused liable to pay that advocate fee as it is only his fault  not  of others as coop.. cociety is run by shareholders .

what is the process in this situation.

please guide.

The issue will come when you win the case. It is a myth that NI 138 cases can be won so easily.

At the time of award, the court can ask him to re-imburse legal expenses to you.
