Legal heir

My Elder mother had  property at chennai she was died on 2024 The property wae ancetral property of her husband  My self resding at same property since from 1983 along my motherand elder mother both were no more  what is procedure to get legai heir..

You submit an application for legal heirship certificate to Tehsildar office within the jurisdiction of the deceased and get 

If the tehsildar is not furnishing the certificate you may file a suit for declaration to declare the legal heirs of the deceased and a mandatory injunction suit to direct the concerned revenue department to issue a legal heirship certificate accordingly.to direct

Apply in the office  of SDM of your zone to get legal heir certificate.

I opine that your elder mother means she is your mother's elder sister, and the property was ancestral to her husband. So her husband's legal heirs have an equal share of her husband's share.  You cannot come under their family; the legal heir certificate may not include your name.

What do you mean by  "my elder mother" as mentioned by you at the start ?

Subsequently you mentioned, inter alia, that,  

"The property wae ancetral property of her husband ........."

Status of property is vague and confusing as to whether the property devolved upon "husband" of your "elder mother" or your "biological mother" ?
