Legal heir certificate

 First question is that with regard whom u required  legal heir certificate ( property, pension benifits,etc.)  depending upon that you have to file suit  for declaration by making the person  as a plaintiff  to whom you want to declare as a legal heir and rest of family members as defendants. legal heir suit can be filed where subject matter is situated.

Thank you for the quick response.

The legal heir certificate is with respect to property in south mumbai which is on my mother's name and the property is under padgi system.

I understand from the legal advice given by the learned experts on this forum is that, my mother cannot make a WILL since the property is acquired under pagdi system.

I was adviced to prove of being a legal heir.

In connection with the above, i want to know the answers to the questions listed in my earlier post above.

Can you please guide me.

P.S. -  No disputes between myself, mother and sister.
