Legal heir certificate

Hello! What is the procedure to get a legal heir / succession certificate for a person (seller) if he claims that his father died 40 years ago. The matter pertains to the state of west bengal. We are trying to authenticate the veracity of his title to an agricultural land as only the LR record is in his name and he claims that the property is ancestral wherein he is the only son of his father.

Succession Certifcate and Legal heirs Certificase are not same issue,you require legal heirs cetificate and there are no issuing authority in West Bengal.Howerver you can ask the seller to produced Affidavit ( this is called legal heirs certificate)which is affirmed before the Judicial Magistrate by declaration of legal heirs of the deceased.It will be needed at the time of mutation.
