Legal heir not in position to apply for succession cert.

1) A property belongs to grandmother, which was bought by her in 1942, not ancestoral,  (The property is in Ambernath, Thane dist, Maharashtra.)

2) Her name still appears on 7/12 extract.

3) She expired in 1998,

4) Her only legal heirs today are a son (my father, expired 2008) and a daughter (my aunty), alive but due to age (82) unable to understand, sign/apply for a succession certificate. (The Talathi insists for a succession certificate for updating record.)

5) So, there are two legal heirs left - me (no brother/sister), and the aunty, (has only one son)

6) If we want to add both the names in the Tehsildar records, we need a succession certificate, and to apply for that, one of the legal heir is unable to apply due to health limitaion.

7) can some expert any remedy?

In some states Patwaari may enter names based on Legal heir certificate/affidavit, death certificate.

The local counsel well versed with family/civil/property/revenue matter can help you.
