Legal heirship

My Aunt is in the hospital. She is a widow without any son or daughter. Her husband had a flat. Her Husband passed away 5 Years ago. She needs to sell the flat for her medical and hospital expenses. It seem she needs a Legal Heir Certificate to sell the flat. I visited couple of First Class Magistrates they are telling me she needs to come to court before the Magistrate but she is unable to visit the court as she is in hospital undergoing treatment. Is there any other way we can obtain the Legal Heir Certificate .She resides in Kolkata, West Bengal.

In such cases where the person is invalid, a person not below the rank of a Magistrate is assigned on legal request.
