Legal terrorism in hma

I write this to express my apprehensions and queries for proposed amendment to Hindu Marriage Act as approved by Cabinet on 17.5.12, particularly regarding giving property rights to divorced women.

 

Let us give men of India also their due in this case, so that no gender biased bill is passed. Instead of giving respite to Men in 498A, dowry cases and domestic violence cases, wherever these are wrongfully filed by women, they are giving them the property of man also, even if he is at no fault and righteous to get the divorce, when woman is at fault or where woman herself wants divorce or where both mutually agree to divorce for reasons other than the property or monetary.

 

My queries are as under –

 

1.    For property acquired by husband before marriage, no contribution is made by the woman, why she should claim that.

2.    If woman remarries, will she give back the property of previous husband(s).

3.    What about property inherited by the man, means not acquired by him, but is acquired by the father before death or forefathers. Particularly in joint families, property is common.

4.    Where court decides that woman is at fault for causing divorce, why man should suffer.

5.    Where women start using this as a tool for grabbing the property of men. Get married, take property and leave the man or make his life hell.

6.    Why only woman be made owner of property, only because she is woman and never contributed to earn the property, particularly before marriage.

7.    Why men should marry after these clauses.

 

Please help men of this country, otherwise this society will crumble and more suicides and murders will take place with these wrongful rights to women.

what about cash as alimony we have to give or we wont have to give money?

I dont want to live with my wife and want to settle with my girlfriend.I love my daughter sbut i dnt wanna take burden of maintainance of them..what should i do?

 Absolutely pertinent topic.

If the law is passed as portrayed.It is an abomination.

There is absolutely no rhime or reason for such a law.

the basic flaws begin on the fact that feminists and woman empowerment folks want to 'equalise' genders.

Scenario 1: Husband is a topper in school, graduates at the top of his class in college, has not seen films, did not watch TV, no vacations,concentrated on studies. Then he is hired by a reputed firm in campus interview works for 10 years. Has good salary. Buys a house. He is very supportive of his family, takes care of parents and sisters. then he marries a middle class, Masters educated working woman without dowry, marries according to traditions. The new wife is unfortunately insulting, abusive, and treats him like an ATM. She leaves work. She gets pregnant and then aborts against the wishes of husband and family. She leaves to see her parents on occasion of marriage of her sister. never comes back, files 498a, DV and divorce. Claims dowry demand, claims maintenance. Claims husband forcibly aborted her. Very typical 'prima facie' case!

As per this law irrespective of whether she is at fault, whether she was cruel, whether she filed false cases. Husband needs to part with half his property, pay maintenance etc etc.

This is a typical case. How can we say the law as suppose to be amended seek to provide justice for the husband? Why does it not punish the errant wife? Not only is the wife not punished but actually rewarded for her bad behaviour. How can law be amended such that it is equitable in providing justice for all parties involved in this case?
