Limitation of time to file fresh suit

My civil case for refund of booking amount of flat is pending since 2016. Now i wants to withdraw it with a permission to file it in RERA. Will court grant me permission? If grants, what will be time limit to file fresh suit in RERA?. As per section 79 of RERA, no civil court will entertain the suits for which RERA is empowered that's why i wants to withdraw. Kindly give your suggestions.

You can withdraw anytime..just withdraw the suit meanwhile file case in RERA and mentioin their that you had eralier file the same case before the cicil court and withdrew that due to lack of juurisdiction
