3) shlould both the male & female partners be single ?

Still to come up with exact definition of live-in.

 

It is legal in India and no bar for married men or women to stay in it, if they don't fear any cases.

Is it a matter of fearness? Its not my point of view but simple query..suppose any male/female r in such relation gives birth to a child den such child is legitmate/illegitmate? is der any legal procedure to be in such relationship?

1. There is no legal status to a live in relationship in India. It is an idea imported from  western culture. However, one can have a live in relationship as a personal liberty with no legal string attached to it, provided the society in which you live in accept it. 

2. The legal definition of live in relationship is “an arrangement of living under which the couples which are unmarried live together to conduct a long-going relationship similarly as in marriage.”

3. The basic idea of cohabitation or conducting a live in relationship  is to test their compatibility for each other before going for marriage. Therefore, naturally the male and the female ought to be unmarried. A married male or female can not conduct a live in relationship with an unmarried one without divorcing. If it happens, it may invite legal or social ramification.

As per latest APEX Judgement, the child born out of wedlock, should have equal rights as legit child of the father.

Sec 125 already says so even if its illegitimate child!

As far as ur main query goes:
Its adultery in the eyes of law if if a married person performs s*x outside marriage. Various other IPC sec are also involved if this s*x is
* Against the wishes of opp partner
* If partner is minor
* If un-natural s*x
* etc etc
If the adults (married/unmarried) do s*x, all with consent & nobody out of them complaints to anybody, its all well!

If adutry is proved, ur wife/husband may seek divorce on this ground.
