Living together

Dear Members

My friend works in Bangalore and lives with his friend who is also his colleague.  They both are not married and doesnt beleive in marriage and also have s*xual relationship.

 

His flat owner wants to vacate them stating the reason that they cannot stay together and other flat occupants are objecting about  their relationship and threatens him that they may go to police and file a complaint.

 

He doesnt want to vacate for this reason and at the same time doesnt want to marry  the same girl.

On what grounds the police will take the complaint? Is it a crime in India that a man and women should not live together ?

Did they sign any agreement with the flat owner that in the event of a situation like this they/he/she will have to vacate the flat?  No its not a crime if both are consentual adults but cops can make it a fake criminal offence if bribed by the flat owner.

there is no offence any police have no power to object to live in relation, recently the SC decided and held that the live-in-relation is not an offence it is a fundamental right and come under article 21 Constitution of India, right to life.

but the landlord has right to vacated the premises according to agreement if any terms and condition is violated from this then he has the right otherwise not.

Dear Mr Randhir and Mr Nadeem , Thank you for the lightning response.

Few clarifications

1.  It seems , only my friend has signed the rental agreement, but his status is known to the owner who stays in the same apartment complex

2. His friend has not signed any document and the general kind of rental agreement has been signed

3.  His landlord  has been succumbed to the preassure of the other owners / tenents who objects this kind of living together status. They feel that their children will get spoiled.... 

few more questions ?

1.  How police can take action if there is a supreme court vertict?

2. If the owner wants to file a case,  under what sections , the  case can be filed ?

 

What is your advise ?

Sivakumar: Check up what you have signed. Read the details. For how much time was the appt. rented out to you?

Rental agreement is valid till 30/06/2012 and living together status is not mentioned anywhere in the terms and conditions doc. But the owner is applying preassure to vacate the premises.
