there are many incident of lock-up death or suicide. but police are not punished because there is no provision of punishment to police officers under indian penal code 1860 and the CrPC.
the reason of lock up death is torture by police to get confession from accused violetting art.22(3) in toto. CrPC did not provide for torture by police to get confession. police is violetting both the CrPC and constitution and still get away because no provision of punishment in IPC.
why there is no provision in IPC for torture by police when constitution and crpc strictly ban torture? isn't it a loophole intentionally kept to protect police?
