Lok adalath procedure

Dear Members,

 

My wife had filed several criminal cases on my family and me.

Finally with mediators, we came for a settlement.

Settlement was through Lok Adalath.

She has agreed in Lok Adalath (in fron of Magostrate) and signed that she shall withdraw all the cases filed, has also agreed for divorce.She received half of the amount as per the settlemet

However now she is not agreeing for divorce and withdrawing cases.

What shall be the consequences, how should I proceed further.

Please help me in guiding in right direction.

Can I file a counter case on her for contempt of court.

As you have mentioned the matter was compromised before Lok Adalat.

Was that a Divorce petition? Was that DMC? Did you both sign any agreement? What was the court order? Why didn't you go to the

Generally in such matters contempt does not lie.  Even then, try your luck by filing contempt petition.  The other method to recover the amount which you had given to her is to file recovery suit.  There are one or two cases, where the wife accepted for MCD and took some monetary benefit and later on refused to give divorce, the courts granted divorce.  You have to search for those cases.
