Lwater leakage problem from upper flat

Hi,

We have been facing leakage from the upper flat for more than a year now. After informing the owner, he always keeps telling he will get it done. The flat has been given on rent.

Then recently the society got it fixed without his knowledge and now he is not ready to pay.

I just wanted to know that is it enough if the society sends him an email telling to get the leakage issue sorted or does the society need to send a paper notice

Society had actually sent him email which he claims that he has not read and he is telling he will not pay as this has been done without his permission.

A. Email communication regarding the leakage issue is sufficient within the purview of electronic evidence under the Evidence Act.

B. You owner has bounden duty to provide good condition flat for peaceful enjoyment. 

C. Lodge your complaint in Society Register Book and insist to resolve leakage problem. Society has right to do this, later society can collect, repair charges from the owner by imposing penalties.
