Sir,

I have just step in Advocacy, after passing LLB last month, I have got a case that is :-

One Mr X was going by TATA SUMO as passenger and he also had the Travelling tickets of that TATA Sumo which he was going, Certainly  an accident occurred and he got injury in chest & back bones etc, so he want to get compensation from the insurance company of the vehicle, the police also take the statement from my client when he was taken to hospital.

Kindly guide me what are the procedure and steps I have to take to file the case under MACT , where and what type of documents I have to collect and go for.

First of all my best wishes to you.

To file a MVC case you have to take FIR, complaint, charge sheet&  spot panchanama .  These are the basic documents you will have to produce while filing the case.  Another important information you have to show that the details of the insurance ie., policy particulars and Name of the Company.  Owner of the TATA is also necessary party & you will have to produce the X'ryas, if any, medical bills case sheet etc.,

Apart from this another important document is disability certiificate for this you have to contact the doctor so many doctors are issuing certificate to get the higher compensation.  AT the time of doctor evidence you will have to get it marked the disability certificate thru., the docotor.
