Maharashtra rent acts 1999 Totally Bias Needs Modification.

Maharashtra rent act 1999 gives permission to the deceased tenant’s heir to reside in the premises but it is easily challenged by false criminal complaints and harassments to the tenants by the owner. The Rent Act is a civil case and does not help in the matter of Criminal Cases. The two are different and are dealt in different courts.

 

After my father death the owner has not accepted rent and henceforth I approached Kalyan Court and deposited the rent in court. The owner of the building is not attending the court but filing false complaints against me. The case being civil he is filing criminal cases. Since one year the property civil case is not come on Hearing its status in court is WAC.

 

Before approaching the court I have given letters to all the police departments about my Life in Danger in the year 2011 and 2012 and the intention of the owner threatening me.

 

I have photo proof how the owner is disturbing But the Asst. Commissioner of police office Dombivli East after seeing the photos and pervious letters filed by me still says this are two different cases. How do I prove aim being targeted by the owner and the case is co-related to my civil case and this criminal cases filed by the owner can be produced as proof to vacate me from my house? The owner is local villager and has got political contacts and himself a builder and developer and everyone is either frightened or obliged to him.

 

The tenants who are poor and have to earn daily hand to mouth, such false police cases filed by the owner is total harassment and the police too helps this villagers who are land developers and politicians this is normal beyond Mumbai limits and in Thane Districts. Aim from Dombivli – West.

 

Tenant can file contempt of court in the civil court as suggested by one of the lawyer but it requires proof of other tenants from the same building. This is not possible the other tenants do not want to take the wrath of the owner and instead help the owner in giving signatures against the tenant who approaches court.

 

The expenses of Advocates and long proceedings of court without any justice the tenants are at the mercy of law. The building owners do not want to repair and renovate the buildings finally resulting to death and disaster in many places of Mumbai and Thane Districts resulting in collapse of buildings.

 

Hope the law makers try to help these poor tenants who are staying in such old and isolated buildings for years and decades only waiting to die. And amend the Rent Act that no legal and criminal cases be filed on the tenant after the case is filed in the court and the tenant is given law protection.
