Maintenance

Sr Iam going through 498a and DV Act,in which maintenance was ordered from date of application after 2 years of case ,now arrears are about 1 lakh and I am unable to pay,my monthly salary is 35k and inhand salary is 16k and maint is 5000 for wife n two child,wat is remedy

1.  Take loan and pay balance alimony.

2.  Bring back wife if you dont want to pay her anything.

3.  You can negotiate with wife for one time settlement and take mutual divorce and ask her to take back all cases on you.

 

Failing to pay will lead to arrest warrant, if caught jail.  If not caught, issuance of NBW, if caught no bail.  Be careful.

Through your advocate file an application to grant time to pay arears in installments, pay monthly maintenance regularly without default.

 

if you feel maintenance is not rightly awarded then file a revision petition before Concerned High Court/appeleate court.

 

which court ordered the maintenance and under which section of law.

if you can share these details then may be some more specific advice may be given by some expert on this forum.

Remedy 1) take your wife back. Live a happy family life 2) go MCD pay one time alimony and get rid of her and cases. 3) pay her some amount which you can pay. It will avoid your arrestment. File a revision petition in high court
