maintenance

can a lady claim maintenance under dv act when she has been already two sets of maintenance under 125 and 24hma? is there any judgement against such multiple maintenances?

She cannot claim multiple maintenance.

Right to claim maintenance exists for wife and she has been provided number of provisions of law where she can claim it from her husband. The problem is that with senseless legal advice of the advocates in profession they want to get maximum out of their husband and so with this idea the applications under all those legal provisions are being filled by them. Each application get them order for maintenance but they get only one maintenance whichever is highest in amount, rest orders for maintenance are being held to be satisfied so even if your wife got two orders for maintenance and now claiming 3rd one, she gets only one maintenance from you whichever is big in amount. Courts cannot refuse to pass order on applications made to them by the wife under different legal provisions. The maximum one court can order is to follow with the same amount already passed in her favor in another application for maintenance. Yes this seems stupidity but unfortunately one can't do anything.
