As per Indian law a husband has to maintain his wife.Now when there is problem with the relation then there is no easy way to get divorce and husband has to provide maintenance to his wife.
As per my understanding maintenance means the amount needed for food and cloth to live and this should not go above Rs1000 per month.Now on what basis the court ask the man to pay 20k and 50k per month as maintenance when it was a short marriage and there is no kids involved.
If the maintenance amount is based on husbands earnings then what is the case when the husband is unemployed ?
In other countries maintenance is only paid when there is kids involved and alimony is calculated on the basis of what husband and wife got together during the period of their marriage whereas in India even for 1 day marriage a husband is forced to pay maintenance to wife her entire life.
Could anyone please make me understand what is exactly maintenance as per India law.Please don't cut and paste the pages of law book here as they always have many meanings and one gets confused reading those laws.The best example is as per HMA a Hindu marriage is between 2 Hindus but it does not say its between a Hindu man and woman which means Hindu marriage is valid between gays and lesb when they are both Hindus.
