1. The burden of proving income is with wife. I believe that ITRs through RTI can only be used by wife in ascertaining the income of the husband. or in case she knows the PAN No , can she be able to find out the income details.
2. As you said, husband should initially admit No Income, but would this not go against him, when wife comes out with income proof?
3. RCR???Wife has already filed for Divorce u/s 13(1). And husband has submitted counterclaim u/s 23 HMA accepting for divorce provided wife withdraws the criminal proceedings.
