Maintenance to wife

I earn Rs.1.3 L p.m. and have liabilities of around 70k per month including LIC premia and other investments. My wife earns 35000 and is also maintaining my child. She has filed a case under DV act and has asked for 70k maintenance for herself and 50k maintenance for the 12 yrs old son. Pls advise...

The court after taking into consideration of statutory deductions from you earnings and your other family responsibilities and her earnings and child's needs come to a conclusion that how much maintenance you have to pay.  No precise calculation method is availavble in maintenance cases like motor accident claims.

A Mumbai  city court has dismissed a maintenance plea filed by a woman after it found out that she earned a monthly salary of Rs 15,000.

You can raise objection against her petition for seeking maintenance for herself , as she is earning good salary, but court can pass order to pay maintenance for your child as you both are liable for his maintenance.
