Hey Ram (Others)     21 December 2024

Married in foreign country without divorcing in india

I got married to my spouse in state of Kerala in 2020 and registered the marriage in India, later we moved to Canada and registered our marriage there in 2021.

In 2022 we got separated and got our divorce in Canada in June 2024. Still we dint file for divorce in India and we are legally married in India as per the records.

After our Canadian divorce, my ex got married to Indian Citizen in Canada in November 2024, Is this a legal marriage as my ex is still legally married to me in India and my ex new husband is Indian citizen

The foreign judgement is valid in india as per law, so no divorce is necessary in indian court, keep the divorce decree  for evidence.

Since she married in Canada as per Canadian laws after Canadian law divorce, her marriage may be considered as legally valid, besides you never contested the divorce granted by Canadian court anytime so far which clealy indicates that you accepted the Canadian divorce especially while youe marriage was once again registered as per Canadian laws, hence you have no case to get her subsequent  marriage nullified for any reason.
