Msk-need -nuetral- laws (self)     25 February 2013

 Stalker, please go though this forum itself where tajobs  gave explanation, you are new to this forum, I think.  That guy is missing for sometime ..any child bearing other than wife , even if no marriage, automatic bigamy.

@Mani

I am sure your observation is wrong and I'll be thankful if someone proves me wrong

@ Stalker,

I am not here to prove  wrong, rather here for sharing and gathering legal aspects. My observation can be wrong as i am a person learning laws , and never declared that I am expert in my profile. even in my postings I always add a line alongwith suggestion to discuss with expert lawyer. However I leave following questions for self answering of you.

1) If an married man have live-in relation with unmarried woman, do you think since no provisions in existing law, he can declare to court right fully that she is his live-in partner when wife is alive? Just imagine what will be court reaction to it, yourself.

2) Why in recent judgements, live-in partners and child born out of it, provided maintenance by court? Is n't that live-in relationship for a period of time gets acknowledgement as married life?

when a live-in partner refuses the relation, for a married person, he is safe and law cannot do anything, the moment live-in partner who says that child is born in relation of a person who was already married, sure, if one of them inititae, bigamy charge is in place.

3) Between have you ever thought why a married person whose divorce case is in court ,by chance  have relation in live-in records to police station that she is his maid.. please anwer yourself,

@Mani,

For bigamy offence one needs two prove two lawful marriages, plain and simple. period.

The kid is an illegitimate child and he is entitled for maintenance.
