Me n my wife are living separately sicne two years now and have a son. She filed a complaint in Women cell delhi and we have been visiting there since an year now but nothis has happened as all councelling and meditaion have failed.Now last month end (28-March) my wife asked to file an FIR through women cell to which women cell staff gave us another date of 7th April for filing FIR and other procedures but meanwhile she filed a mediation case at delhi high court and I recd that letter from high court on 4th April. On the date at women cell (7th april) I informed this to my investigative officer and also that my wife delibrately didnt informed me and even women cell in last meet that she is filing for mediation also at high court. Now,women cell have refused to file FIR against me as they say that High court is above and now me and my wife need to attend the mediation and asked her if she wants FIR then the high court mediation case must be closed first. So, now I have few queries:
1) Shoul I go for high court mediation as it will also be time consuming. My wife ask for 3 crore rupees as maintainence of my child which is unrealistic as I earn 30 thousand a month and dont have any properties in my name. She asks foe my home belonging to my parents and also asks for bank account money of my mothhers account. I am even ready to take my child and his brought up but my wife is not eady to give as my child is her bargain power for asking money as she is earning well....So with this behavior should I go to high court mediation or not? As I can opt out from this and this is even writen in the letter I recd.
2) As, my wife did this mediation case along with the ongoing procedure at womrn cell just to pressurise me but landed up herself in difficult situation where no she can not file FIR until the high court mediation case is closed, but I want to ask that if we close the mediation case and she file a FIR agaisnt me, then what will be the outcome? Do I need to get and anticipatory bail? Can I get arested inspite of we are living separately since two years now? She threatens to file a domestic voilence and dowry cases... so what should be my actions? plz guide.
3) Lastly I want to say that I just want to be free and live a happy life, so plz guide which option should I go for, a mediation at high court, FIR through women cell by my wife and after that police investigation will go on and then trial will start at court, or I file a divorce case directly in court. I have posted other threads also earlier in past where I have mentioned the behavior of my wife... she has pathetic thinking and alleges me that I am having illegal relations with my bhabhi, even my mother? How can this type of women sustain in a fimily pkz help...
