Mcop act

Sir,

I sold my car to X , delivered and got delivery note in original and sale receipt in Xerox copy retained with me.

X used the car without transferring the name (ownership) and without renewing the insurance and met with an accident. The injured person got compensation as per MCOP act.

Now the court is asking both-- me and the X-- to pay for the injured.

Now    1. I have not used the car at the time accident.

                2. I am not  the owner of the car

                3. Name (ownership) transfer and insurance renewal is the duty of the buyer

For his mistake , I have been penalized. Why?

What to do Now?

Please help me.

you can submit all the document for sale related, before the judge, you will put the reply that i am not liable to the case, because i am not owner of the vehicle at the time of met accident. with affidavit.

Sir,

I already submitted all documents and affidavit thro' a lawyer, appeared in the court -witness given and the lawyer told me the case dismissed - I have been released.

But , since the X has not contested the case - an exparty order has been passed.Now the injured's lawyer is sending me the notice to pay the compensation.

Is it correct? What todo?
