Medical maltreatment

Respected members,

The complainant's daughter(16 year old) died because of the maltreatment by the doctor( she was suffering from a head injury caused by an accident) The doctors kept her in ICU for around 20 days and after that, she was declared as a COVID patient by them and transferred to the covid center, where she died. The Post mortem report declared the cause of death as Brain Hemorrhage. Also it was found later that the covid report was actually negative.Can the complainant sue the attending medical staff and what legal remedies does she have??

can be filed complaint in consumer forums for compensation/damages. The forums have a variety of powers. They are 1) the summoning and enforcing of the attendance of any defendant or witness and examining the witness under oath, 2) the discovery and production of any document or other material object producible as evidence, 3) the reception of evidence on affidavits, 4) the summoning of any expert evidence or testimony, 5) the requisitioning of the report of the concerned analysis or test from the appropriate laboratory or from any other relevant source, 6) issuing of any commission for the examination of any witness, and 7) any other matter which may be prescribed.

Along with the above mentioned consumer court suit one should also write to IMA Indian Medical Association and BMC Health department.... Pressure must be created from all the side and prayer to suspend medical practice pending the disposal of this case.
