MINORS PROPERTY

Mother of Minor demanding the amount of Fixed Deposits (which are in the name of Minor and Mothers name has been recorded there as guardian for minor)  from the Bank?

But the Bank denying to handover the amount mentioning that Court direction is necessory for disposal of minors property.

so what type of action is necessory to resolve above issue

The Hindu Minority And Guardianship Act, 1956 

will apply as fas as my opinion is concerned.

becasue it is a movable property & not a immovable property if the property is immovable then section 8 is applicable.

let's see what are LD members has to answers.

If possible they may support the case law on it.

Bank is absolutely right in this matter.If you want to use that amount then you will have to take court order.


You have a thinking why bank deny to give amount?

The answer is simple:If bank will give amount and suppose ,any problem arose in future then bank will be in trouble.Thats why in many cases bank deny it.Bank put this matter on court.If court have a order then bank must follow the decision.

You havent give more info about the amount that have been depoisited in the name of minor.

What are the terms and condition in that matter that you have to further study.
