Misbehaviour of civil servant

what action can be taken when a civil er. of irrigation department use some abusive language against anyone on whatsapp and the other person response in same abusive language to him in return.

He can't be prosecuted but can be sued.

Giving Section 80 ( of The Civil Procedure Code ) Notice is unnecessary.     Because use of abusive language is not his duty.
