Misuse of : Provisions meant for Econ. Backward Sections

In the instance of "Misuse of  Provisions meant for Economically Backward Sections/Segments of Society"

 

 

What provisions of IPC are attracted? and what sort of punishment interms of imprisonment and or file prescribed?

 

 

There are many such forums and facilities provided for Eco. Backward/less previleged segments (To even upper classes who are poor, physically challenged, minors or weaker genders etc)  by

1. Directly byGovernment

2. directly by private/social NGOs

3. charity by Corporates

 

 

Wherein above entities do disburse or ask to disburse some help in terms of money, loan, equipment or other material if not cash given to such needy people (rationing of food grains rice, wheat, kerocene)

Or Govt does issue orders to no2. and no 3 entities to do the needful and reccommends names of such needy people.

 

 

If somebody (who is wealthy and does not fir the defition of needy) is found to be taking above benefits by concealing truth and misleading, then under offence he be tried and where does one should lodge a compliant against such person?

1.
By RTI gather replies data of such persons.
2. Inform by way of complaint to concerned Authorities.
3. Follow up by RTI of Action Taken Report in general public interest which is the widest one can think of.
4. Pops deletion of names of misusers and penalty if prayed for.
Illustration:
A and B are both Govt. servants. Both have CGHS Cards and both have other spouse names as benefitiories. it is allowed as per Service Rules nothing wrong in it. B moves out of A. A does not delete name of B. But B instead of deleting A's name adds her dependents senior citizens name by bribing concerned authorities. A moves RTI. Gathers relevant materials and files complaint follows it up ATR. Result penalty from back date to B and deduction of arrears from pay and deletion of all dependents from CGHS card.

The problem in our system is that .... if a person does something which is prohibited under IPC 406, 415 420 etc

 

that person gets punishment.

 

But when a person commits a fraud or perjury etc in a trial, he is more or less spared.................although That is also equally a breach of trust as well as cheating to induce something or to gain something deceitfully.
